Warranties and Representations. (a) DMS shall indemnify, defend and hold harmless Consignee and its officers, directors, agents and employees, from and against any damage, liability, losses, and costs (including reasonable attorney fees and costs of litigation) arising out of or in connection with the followings: (1) any breach by DMS of any term or provision of the Agreement; (2) injury as a result of any defect in any of the Products; (3) claim, action and lawsuit by any third party which insists that Consignee infringes its patents with respect to any one or more of the Products; and (4) any other claims from any customer with respect to the Products to the extent Consignee did not contribute to the claim.

保证和表现。 (a)将保护， 保护并且容纳无害的收货人和它的官员，主管，代理人和雇员， 根据任何损害和对任何损害， 责任，损失，或者有关如下内容和花费(包括合理律师费和诉讼的费用)因而产生： (1)破坏任何以开庭期间或者供应任何的那些协议的； (2)由于在任何产品内的任何缺陷的伤； (3)通过任何第三者，坚持说收货人破坏它的与任何程度一个或多个的产品有关的专利的索赔，行动和诉讼； 并且 (4)任何对程度收货人与产品有关的用户的任何其他索赔没有助于索赔。
